Subcomponent 1.1 

 

Develop of a new Law on Control on Emissions from Industry according to an inclusive and evidence-based approach and in accordance with the Industrial Emissions Directive (IED) 2010/75/EU.

 

Mission 1.1.1: Assessment of the gap in the degree of compliance of existing legislation with the IED

 

The 2nd mission of the project was conducted in the period 26th - 29th of September 2017. Arend Kolhoff, from the Netherlands and Zdenek Suchanek, from the Czech Republic were the Short-Term Experts (STEs) assigned to the mission.

Before the start of the mission and during the mission, both STEs, analysed the relevant legislation and documentation

During the mission both STEs held meetings with experts from Ministry of Environment and Natural Resources Protection of Georgia (MENRP).

With the input acquired through the review of the legislation and the additional documentation provided by the Twinning Office, as well as from the meetings held, the STE prepared the Report including the results of the gap analysis and containing comparative tables on the degree of compliance with the IED.

Mission 1.1.2. Part 1: Preparation of the Law on Control of Emissions from Industry accompanied with Table of Concordance and report on stakeholder consultations including a workshop after the 1st draft

 

The 3rd mission of the project was performed in 4 working days in the period 2nd - 5th October 2017.

Arend Kolhoff, from the Netherlands and Katia Juárez, from Spain were the Short-Term Experts (STEs) assigned to the mission.

Before the start of the mission, both STEs, analysed the relevant legislation and documentation including the outputs of mission 1.1.1:

STEs experts were provided additional documents during the mission.

During the mission the STEs held meetings with relevant officials from the Environmental Impact Permits Department and the Legal Department of the Ministry of Environment and Natural Resources Protection of Georgia (MENRP)

With the input acquired through the review of the legislation and the additional documentation provided by the Twinning Office, as well as from the meetings held, the STE prepared the 1st version of the draft law on control of industrial emissions.

Mission 1.1.2 Part 2 : Preparation of the Law on Control of Emissions from Industry accompanied with Table of Concordance and report on stakeholder consultations including workshop after the 1st draft

 

This 7th mission of the project was performed in 4 working days in the period 14th - 17th November 2017.

Zdenĕk Suchánek and Monika Přibylová from the Czech Republic were the Short-Term Experts (STEs) assigned to the mission.

 

Before the start of the mission, both STEs, analysed the relevant legislation and documentation including the outputs of mission 1.1.1 and 1.1.2. Part 1. During the mission STEs were provided additional documents.

During the mission the STEs, held one meeting with relevant officials of the Environmental Impact Permits Department of the Ministry of Environment and Natural Resources Protection of Georgia (MENRP).

Additionally, the STEs held several meetings with the RTA in which specific aspects of the drafting of the law on control of industrial emissions were discussed.

On 17th of November 2017 a workshop was held in the Environmental Information and Education Centre of the MENRP in which officials and staff of the Legal Department, Environmental Impact Permits Department, Department of Integrated Management and Waste and Chemicals Management Service of the MENRP participated.

Based on the version of the draft law on control of industrial emissions prepared in mission 1.1.2. Part 1 (document 1.1.2. Part 1 Draft law on control of industrial emissions. Version 1) and with the input resulting from the discussions and meetings held and the workshop, the STEs prepared the second version of the draft law on control of industrial emissions which is one of the outputs of the mission.

Mission 1.1.3 Part 1: Preparation of an explanatory note, including regulatory and fiscal impact assessments for the draft law on Control of Emissions 

 

The 5th mission of the project was performed in 4 working days in the period 24th – 27th of October 2017. 

Wybe Douma, from the Netherlands was the Short-Term Expert (STE) assigned to the mission. The second STE assigned to the mission was Jan Prasek who could not participate in the mission in the period 24th – 27th October and he did it in the period 21st - 24th November 2017.

Before the start of the mission, the STEs, had access to the relevant documentation including the outputs of missions 1.1.1 and 1.1.2. Part 1. During the mission the STE was provided additional documents.

The STEs held meetings with relevant officials of Ambient Air Division of the Department of Integrated Management and of the Environmental Impacts Permits Department of the Ministry of Environment and Natural Resources Protection of Georgia (MENRP). Meetings were also held with the RTA and RTA counterpart

With the input acquired through the review of the legislation and the additional documentation provided by the Twinning Office, as well as from the meetings held, the STE prepared the 1st version of the regulatory impact assessment of the law on control of industrial emissions of Georgia.

Mission 1.1.3 Part 2: Preparation of an explanatory note, including regulatory and fiscal impact assessments for the draft law on Control of Emissions 

 

The 8th mission of the project was performed in 4 working days between 21st and 24th of November 2017.

Wybe Douma, from the Netherlands and Petra Matuskova, from the Czech Republic, were the Short-Term Expert (STE) assigned to the mission.

Before the start of the mission, the STEs, had access to the relevant documentation including the following outputs of missions 1.1.1, 1.1.2 and 1.1.3 Part 1.

The STEs held meetings with the Legal Department of the Ministry of Environment and Natural Resources Protection and with the RTA. The issues discussed included the first drafts of regulatory impact assessment and the explanatory note which will be updated once the final version of the Law on control of industrial emissions is issued. Regarding the coordinated or joint procedure with the EIA, the guidance issued by the European Commission was discussed. The role of the NGOs as part of the public concerned was also discussed. The composition of the expert commission of the EIA procedure in the new Code on environmental assessment and the status of its members was also among the topics discussed. Finally, the draft by-law on waste incineration and co-incineration was discussed.

Changes from first to second versions of the regulatory impact assessment and the explanatory note were limited since no sufficient information was available to make more progress. Changes will be added whenever additional information is available, mainly regarding the number of installations covered by the IED in Georgia. If templates and guidance documents for the elaboration of RIA in Georgia mentioned above are made available, both documents will be changed accordingly, if appropriate. Changes will be introduced when the final version of the draft law is available.

 

Additional tasks were assigned during the mission to the STEs by the RTA which included the following:

 

·         To review and to make comments on the draft law

·         To prepare the guiding note on Coordinated or joint procedures for assessment of effects on the environment (Wybe Douma)

·         To work on the further elaboration of the corresponding Table of Concordance

Mission 1.1.7: Training on integrated approach as provided in the Industrial Emissions Directive (IED) for the departments within the MENRP and other Ministries involved in the IED process

 

This 9th mission of the project was performed in 3 working days between 5th and 7th of December 2017.

Jan Kolar (Czech Republic) and Jüri Truusa (Estonia) and were the Short-Term Experts (STEs) assigned to the mission.

Before the start of the mission, the STEs prepared the draft versions of the presentations for the training on integrated approach as provided in the Industrial Emissions Directive (IED). The following topics were considered for training:

  • Installations and directly associated activities
  • Local conditions and environmental quality standards
  • Best Available Techniques (BAT)
  • Application of BREF documents
  • Establishment of Emission Limit Values and other permit conditions
  • Technical expertise for the different industrial activities and types of installations for which permits have to be issued
  • Abatement techniques for emissions to water, air and soil
  • Prevention and reduction of noise, vibrations and odour
  • Waste: measures for the prevention, preparation for re-use, recycling and recovery of waste generated by the installation
  • Operator self-monitoring

Trainees from the Ministry of Environment and Natural Resources Protection were selected before the mission:

On the first day of the mission the STEs discussed with the RTA the detailed agenda of the training, materials to be used and the expected results. Based on the discussion the STEs finalized the presentations for the training session.

The training was conducted in 2 sessions, with a first session on 06.12.2017 and a second session on 07.12.2017
